Welcome to AncientHerb. These Terms of Service ("Terms") govern your access to and use of the AncientHerb web application (the "App") provided by Natural Health Consulting LLC ("we," "us," or "our"), a Florida limited liability company.

By accessing or using AncientHerb, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

You acknowledge and agree that:

3.3 No Diagnosis or Treatment

The App does not diagnose medical conditions, prescribe treatments, or provide medical advice. Any personalization is based solely on information you provide and general Ayurvedic principles, not on medical evaluation.

4. User Conduct and Community Guidelines

4.1 Acceptable Use

You agree to use AncientHerb only for lawful purposes and in accordance with these Terms. You agree not to:

• Attempt to gain unauthorized access to the App or other users' accounts
• Interfere with or disrupt the App or servers

4.2 Community and Private Messages

The App includes social features where users can share experiences and communicate. You acknowledge that:

• Content posted by other users reflects their own opinions and experiences
• We do not endorse or verify user-generated content
• You should never follow medical advice from other users
• We are not responsible for interactions between users

5. Intellectual Property Rights

8.2 No Guarantee of Accuracy

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The information provided is accurate, complete, or current
• Any errors will be corrected
• The App is free from viruses or harmful components

8.3 Health Outcomes

WE MAKE NO GUARANTEES OR WARRANTIES REGARDING HEALTH OUTCOMES, IMPROVEMENTS, OR RESULTS FROM USING THE APP OR FOLLOWING ANY SUGGESTIONS PROVIDED.

8.4 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NATURAL HEALTH CONSULTING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of the App
• Any bugs, viruses, or other harmful code transmitted through the App
• Any errors or omissions in content
• Any user content or conduct of third parties on the App
• Implementation of any suggestions or recommendations from the App

8.5 Maximum Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

8.6 State Law Variations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.

11. Modifications to the App and Terms

11.1 Changes to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, and without liability to you.

11.2 Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by:

• Posting the updated Terms on the App
• Sending you an email (if you have provided one)
• Displaying a notification when you log in

Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

12.1 Termination by You

12.2 Termination by Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice, for any reason including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Prolonged inactivity
• At our sole discretion

12.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• We may delete your account and data
• Sections of these Terms that by their nature should survive will survive, including disclaimers, limitations of liability, and dispute resolution provisions

13. Dispute Resolution and Governing Law

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

13.2 Informal Resolution

Before filing a claim, you agree to contact us at ancientherbhealing@proton.me to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 60 days.

13.3 Arbitration Agreement

If we cannot resolve a dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

The arbitration will be conducted in Florida, and judgment on the arbitration award may be entered in any court having jurisdiction. Each party will bear its own costs and attorneys' fees unless the arbitrator determines otherwise.

13.4 Class Action Waiver

YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN YOU AND US INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

13.5 Exceptions

Nothing in this section prevents either party from seeking injunctive or other equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Natural Health Consulting LLC regarding the App and supersede all prior agreements and understandings.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

14.6 Export Controls

You agree to comply with all applicable export and re-export control laws and regulations in your use of the App.

14.7 Language

These Terms were written in English. To the extent any translated version conflicts with the English version, the English version controls.
